App Privacy Policy



At Toja. TJ Ltd (hereinafter referred to as “Toja”, “we” or “us”), we are committed to protecting and respecting your privacy.



This Privacy Policy contains important information about how we collect, manage and use any personal information that you provide when you visit or register for an account on our mobile app (the “App”), request to join our mailing list or contact us directly. For the purposes of applicable data privacy legislation, Toja is the "controller" of the personal information collected through the App.



We may change this Privacy Policy from time to time. Please check back regularly so that you are aware of the most recent version and the date that it was last updated.



How we collect your personal information



When you register for an account on the App



If you register for a “consumer” account on the App, we will collect personal information about you including your name, email address, password and contact number. Alternatively, you can sign up for a “consumer” account through your Google, Facebook or Apple account. Should you choose this option, we will collect personal information including your name and contact details (such as your email and/ or contact number). 



Once you have registered for a “consumer” account, we will also collect your location information (and you may determine the extent and frequency with which we collect this information through your device settings). We will also collect any photo of you that you choose to provide during your account set up.  



If you register for a “vendor” account on the App, we will collect personal information about you including your company name, email address, password, company address and contact number. 



We will use this information to: 

  • send you an email asking you to confirm your registration (we do this to make sure we have the correct email address); 

  • create and maintain your account with us; 

  • respond to any requests and enquiries efficiently; 

  • notify you about changes to our service or to the App; 

  • develop and test the App; 

  • undertake statistical analysis of anonymised personal information in order to better understand how the App and its content is interacted with, and how the App can be improved;

  • determine your location, so that we can offer products and services within your chosen range of travel;

  • provide you with information about products or services that we or our affiliates offer, if you consent to us doing so or we are otherwise permitted to send marketing communications in accordance with applicable laws (see “Promotional communications” below); 

  • comply with any legal obligations we are subject to, and to protect and defend our rights and those of third parties.

When you contact us



If you contact us through the App, you will be directed to Toja’s Whatsapp contact page. Should you choose to message Toja on Whatsapp, we will collect your contact number, username, the details of your profile’s “about” section and any information that you choose to provide. 



We will use the information you give us to review, investigate and respond to your comments or questions as necessary.



Promotional communications



Where required in accordance with applicable laws, we may, with your consent, contact you by email to provide you with information about products or services that we and/ or our affiliates think may be of interest to you. You can unsubscribe at any time by following the unsubscribe link at the bottom of any promotional email that we send to you.



Retention of personal information 



We will hold your personal information on our systems for as long as necessary to fulfil the purposes that we collected it for, as explained in this Privacy Policy, and for the purposes of satisfying any legal requirements to which we are subject. Where there are no such requirements, we will hold your personal information in a form which identifies you for as long as appears appropriate based on the amount, nature and sensitivity of the personal information and the potential risk of harm from unauthorised use or disclosure of your personal information.  



If you ask us to delete your information in accordance with your rights set out below, we may retain basic information on a suppression list to record your request and to avoid sending you unwanted materials in the future.



Sharing your information



We may share your information with selected third parties including:



  • Vendors who make their goods and services available through the App, where you redeem a deal or offer with them;

  • Analytics and search engine providers that assist us in the improvement and optimisation of our App;

  • Third parties that provide IT services to us, such as the company that hosts the App for us;

  • If we merge with another organisation or form a new entity, your personal information may be transferred to that new entity.

We may also disclose your personal information to third parties if we need to in order to:



  • comply with any court order or other legal obligation or when information is requested by our regulators or by government agencies or law enforcement agencies;

  • enforce or apply our terms of use and other agreements;

  • protect the rights, property, or safety of us, our employees, or others.

How you can access and update your information



We strive to maintain accurate, complete, and relevant personal information for the purposes identified in this policy. If any of the personal information we hold about you is inaccurate or out of date, please let us know and ask us to correct it. If you have an account on the App, you can update your personal information directly.



Where the EU GDPR or UK GDPR apply to the processing of your personal information



What is our legal basis for using your personal information?



Where the UK General Data Protection Regulation (“UK GDPR”) or EU General Data Protection Regulation (2016/679) (“EU GDPR”) (together the “GDPR”) apply to our processing of your personal information, we need to rely on one or more lawful bases. The lawful bases we rely on include the following:



  • If you register for an account on the App or contact us directly, our lawful basis for processing your personal information is that we have a legitimate interest in doing so. This means that we can process your personal information if (i) we have a genuine and legitimate reason (in this case, the operation of Toja); and (ii) our legitimate interest is not overridden by your rights and freedoms. 

  • If you redeem a deal or offer on the App, our lawful basis for processing your personal information is that this is necessary for the performance of a contract to which you are party.

  • If you agree to receive news, promotions and other offers by email, including those of our affiliates, our lawful basis for processing your personal information is that you have provided consent to us doing so. You can withdraw your consent at any time by clicking the ‘Unsubscribe’ button at the bottom of any promotional email that we send to you. Please note that in order to fulfil your request we will keep your e-mail address for “suppression” purposes in order to ensure that you do not receive any further promotional communications in this way.

  • We may process your personal information if we are required to do so in order to comply with our legal obligations, to establish and defend our legal rights, or to prevent and detect crimes, such as fraud or misuse of or damage to our property.

International transfers of personal information



From time to time, we may transfer your personal information outside of the UK and the EU to service providers or other Toja group entities for the purposes described in this Privacy Policy. If we do this and the GDPR applies to our processing of your personal information, we will ensure that your personal information is adequately protected, where necessary, through the adoption of appropriate safeguards such as regulator approved model clauses. We will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this Privacy Policy. 



Your rights in relation to your personal information



You have rights in relation to the personal information we hold about you, where the GDPR applies to its processing. These include the right to request access to your personal information, to request that it is erased, that its processing is restricted, or that any inaccurate personal information is rectified. You may also have the right to object to the processing of your information, or in some circumstances to obtain a copy of the personal information in machine-readable format. Please note that these rights are not absolute in all circumstances.

We may ask for proof of identity and sufficient information about your interactions with us so that we can locate your personal information, and ensure that we are only releasing personal information to those entitled to receive it. Where we provide personal information to you (or someone else on your behalf), we will provide it free of charge except in exceptional circumstances.
